Terms of Service

The below agreement contains important information about your rights as a user, as well as legal remedies and obligations.

1. Description of Service

  1. Stoic Nature Inc. ("we", "us", "our", "Stoic Nature") is the owner of the Stoic Nature mobile application ("Stoic Nature" or "the App"). Stoic Nature Inc. is a limited company with headquarters in Toronto, Canada. Contact us at support@stoicnature.com.

  2. Stoic Nature is a mobile application that teaches users the basics of Stoicism, and allows them to swipe through quotes and maintain a personal journal crafted from a wide range of topics (the "Service"). Presently the Stoic Nature app is entirely free of charge. This is something which can be subject to change in the future. Within these terms of service ("Agreement"), the aforementioned features are collectively referred to as the "Service" unless otherwise noted.

2. User Acceptance

  1. "You", "your" or "user" means an adult user of the Service acting independently or as parent or guardian of any minor whom you authorize to access the Service and for whom you are held strictly responsible.

  2. By accessing or using Stoic Nature you acknowledge that you have read, understood, and agreed to this Agreement, whether or not you are a registered user.

3. Access, Usage and Modification

  1. We reserve the right to update, adjust, save, modify, add or remove features and content and to redesign, improve or otherwise modify the Service.

  2. We may decide to update our terms of service. If we believe the changes are material, we will notify you by one ( or more ) of the following actions: (1) posting the changes through the Service, or (2) sending you an email or message about the changes. The Modifications will apply to all current and former users of the Services as of their effective date and will replace any prior agreements. By accessing the Services on or after the effective date of the modifications, you are deemed to consent to the new terms of service in effect then in effect.

4. Creating an Account

  1. Registration. Stoic Nature users may create an account by following the instructions on the App. Stoic Nature reserves the right to reject any new registration or cancel any existing account at any time and for any reason. We do not accept registration from users under the age of 15. By registering with Stoic Nature, you are declaring that you are at least 15 years old. If you are 15 years of age or older but under the age of 18, you must review this agreement with your parent or legal guardian to ensure that you and your parent or legal guardian understand the agreement and agree to abide by it.

  2. Users are responsible for all activities that occur on their account. They must immediately notify Stoic Nature of any unauthorized use of their account, or any other account-related security breach of which they become aware.

  3. Any breach or violation of any term of this Agreement will result in immediate termination of the account.

  4. Stoic Nature accounts and subscriptions are non-transferable and may not be sold, traded or transferred in any way.

5. App Subscriptions

  1. Presently the Stoic Nature app is entirely free of charge. This is something which can be subject to change in the future. We reserve the right to change our prices (including starting to charge for a Service we currently provide free of charge) and billing methods at any time. If you are an existing subscriber, you may be required to accept these changes at the end of the current term in order to continue to receive the Services. We will notify you either on the App or via email.

  2. If we decide to implement a Subscription for Stoic Nature, all relevant rights, legal remedies and obligations will be updated in this Terms of Service. These new rights, legal remedies and obligations will become effective immediately when that occurs.

6. Cancellation of the Service

  1. We may suspend or terminate your use of the Service due to fraud on your part or breach of any obligation under this Agreement. Such termination or suspension may be immediate and without notice. A breach of this agreement includes, but is not limited to unauthorized copying or downloading of our textual content from the Application.

7. Data Encryption

  1. All journal entries on Stoic Nature are encrypted using AES with a 256 bits key. This means that no internal employee of Stoic Nature can read your journal entries. No entry of yours can ever be read nor distributed externally. To learn more about how we process your data, read our privacy policy.

8. User Content

  1. User content. You may write anything you like in the journals (collectively, "User Content") as part of your use of the Service.

  2. Personal data. The personal data you submit to Stoic Nature is subject to Stoic Nature’s privacy policy.

  3. No control over user content. We do not endorse or control user content, and we cannot guarantee the authenticity of any information users may provide about themselves, including their identity. If you provide any public information that is untrue, inaccurate, not current or incomplete, or if Stoic Nature has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Stoic Nature has the right to deactivate or terminate your account and refuse any and all current or future use of the Service (or any portion of it) without liability. You acknowledge that you are accessing the content of the Service knowingly and that you will be solely responsible for any damage or loss of content to you or any other party resulting from it.

  4. Communication Services. The App may contain features (including user reviews, etc.) that allow users to post content PUBLICLY on the App or in discussion forums on third-party applications such as Facebook (collectively the "Communication Services") and users may also post content via our official brand presence on social media platforms and branded hashtags (including, without limitation, Facebook, Twitter, YouTube, Instagram, LinkedIn and Pinterest, collectively the "Social Media Platforms"). You agree not to post or transmit any communications or content through the Communication Services or the Social Media Platforms that infringe or violate the rights of any party or any applicable law. By submitting communications or content through Communication Services or Social Media Platforms, you agree that such submission is non-confidential for any purpose. You agree to use the Communication Services only to post, send and receive messages and material that are appropriate and in-line with such Communication Services.

  5. Media. You agree to post or upload to any PUBLIC portion of the Communication Services or Social Media Platform only media materials (such as photos, videos, or audio) that you own and/or have the rights to transmit, and that do not infringe the trademark rights, copyrights, privacy, or other rights of any other person or entity. By posting a Media Item on the App or on a Social Media Platform, you ensure that you have the permission of all persons appearing in your Media Item and the rights stated in this agreement to post it. Never post a media item in which a person whose permission you explicitly grant appears.

  6. Hate speech. You are strictly prohibited from posting any material or content of any kind that contains hate speech, abuse, offensive, obscene, pornographic, sexually explicit images or conduct, or that may give rise to criminal or civil liability under applicable laws or regulations, or that may conflict with our Terms of Use or Privacy Policy.

  7. User Warranties. You warrant, represent, and can demonstrate upon our request, that all information and user content posted or transmitted through the Service is the sole responsibility of the user posting it. Stoic Nature will not be responsible for any errors or omissions in user content.

9. Terms and Conditions of Use

1. You agree to use the Service only for lawful purposes and NOT to:

  1. engage in conduct that is unlawful, immoral, threatening, abusive, or in a manner deemed unreasonable by Stoic Nature in its sole discretion;

  2. use the Service in a manner that violates this agreement;

  3. act fraudulently or maliciously, by hacking or inserting malicious code, including viruses, or harmful data, into the Service or any operating system;

  4. infringe our intellectual property rights or those of any third party in connection with your use of the Service;

  5. transmit any confidential or proprietary material;

  6. use the Service in a manner that could damage, disable, overburden, or impair our systems or security or interfere with other users;

  7. collect social security or insurance numbers, financial account numbers, driver's license numbers, health information or other sensitive information required to be secured by local, state, provincial, national or other laws, rules or regulations, or required to be disclosed in the event of a data breach, without our prior written consent;

  8. collect or harvest any information or data from the Service or attempt to decrypt any transmission to or from the servers running any Service;

  9. access the Service to build a similar or competitive product or service or copy any idea, feature, function, or graphic from the Service;

  10. use the Service in a manner that may harm minors or interact with or target persons under the age of 13;

  11. impersonate any person or entity, including, but not limited to, one of our employees, or falsely state or otherwise misrepresent your affiliation with a person, organization, or entity;

  12. access, search or create accounts for the Service by any means other than our public interfaces (e.g., scraping or creating accounts in bulk);

  13. send unsolicited communications, promotions or advertising, or spam;

  14. Send modified, misleading or false credentials, including spoofing or phishing;

  15. sublicense, resell, or otherwise exploit the Service;

  16. authorize, allow, induce or encourage any third party to do any of the above activities.

10. Intellectual Property Rights

  1. You acknowledge and agree that Stoic Nature retains ownership of all Stoic Nature intellectual property embodied in the Service (including all improvements, updates and fixes) and any intellectual property generated by Stoic Nature for the purpose of providing the Service.

  2. You ensure that by using the service you will not :
    1. use any of Stoic Nature’s intellectual property without explicit consent;
    2. copy any part of the Service for your own commercial purposes; or
    3. directly or indirectly copy, recreate, decompile, reverse engineer or otherwise obtain, modify or use any source code or object, architecture, algorithms contained in any associated documentation.

  3. All content published on Stoic Nature is protected by copyright laws in the United States and/or other foreign countries. Subject to your payment of the applicable subscription fees (if any), Stoic Nature authorizes you to view or copy the data on the App solely for your personal, non-commercial use. Any special rules for the use of certain software and other items accessible on the App are incorporated into this agreement by reference. All rights not expressly granted in this agreement are reserved to Stoic Nature and its licensors.

  4. If you violate any of these conditions, your authorization to use the data will automatically terminate and you will be required to immediately destroy any copies you have made of any portion of the data.

11. Advertising

1. Communications

  1. Stoic Nature may send you marketing or promotional materials or other information regarding your account, the Service, or any similar services provided by Stoic Nature.

  2. Stoic Nature will only send you newsletters or advertise third party services if you have requested to receive these communications.

  3. You may choose not to receive any or all of these communications from us or from third parties by following the unsubscribe link or instructions provided in any email we send.

12. Warranties, liability, indemnification and exclusive remedy

  1. STOIC NATURE DOES NOT WARRANT THAT THE SERVICE WILL BE PERFORMED WITHOUT ERROR OR INTERRUPTION, OR THAT STOIC NATURE WILL CORRECT ALL SERVICE ERRORS.

  2. STOIC NATURE IS NOT RESPONSIBLE FOR (1) ANY CONTENT POSTED BY USERS ON OUR SERVICE; (2) ANY DAMAGES RESULTING FROM THE USE OF OUR SERVICE; (3) ANY NEGATIVE OR CRITICAL COMMENTS THAT MAY BE POSTED BY USERS, OR ANY OTHER THIRD PARTY THROUGH THE SERVICE; OR (4) ANY THIRD PARTY SERVICES THAT MAY BE PROVIDED TO YOU AS A RESULT OF YOUR USE OF THE SERVICE

  3. FORCE MAJEURE. WE WILL NOT BE LIABLE TO YOU FOR ANY LACK OF PERFORMANCE, FOR UNAVAILABILITY, FOR FAILURE OF THE SERVICE, OR FOR ANY FAILURE OR DELAY BY STOIC NATURE TO COMPLY WITH THIS AGREEMENT, IN THE EVENT THAT SUCH LACK, UNAVAILABILITY OR FAILURE ARISES FROM ANY CAUSE BEYOND OUR REASONABLE CONTROL.

13. Medical Liability

  1. Stoic Nature provides a mobile application that facilitates personal mobile journaling related to mental health and Stoicism. However, we are not a health care or medical provider, and our service should not be considered medical advice. Only your doctor or other healthcare professional can provide that. While there are studies and research that show that journaling can help prevent and assist in the healing of many psychological disorders, as well as improve certain performance and relationship issues, Stoic Nature does not claim, represent or guarantee that the service provides any therapeutic benefit.

  2. All mental health information and links on the Service are provided solely in the interest of your general information.

  3. People with mental health problems should consult their doctor before starting to journal.

14. Information

  2. A consent, notice or disclosure under this agreement is valid if sent as an electronic communication, unless physical delivery is required by law. You consent to receive electronic communications and agree that all agreements, notices, disclosures, and other communications we provide to you electronically, by email, on our website, or on the App, satisfy any legal requirement that they be in writing.

15. Litigation

  1. If you are not satisfied with our service, please let us know and we will work to resolve your issue. If we are unsuccessful, these rules will apply to any dispute involving our Service.

  2. Amicable Resolution. We will do our best to resolve any dispute amicably.

  3. Mediation. You can send any complaint directly to us at support@stoicnature.com, and we will do our best to find a solution.

  4. Applicable law. The agreement is governed by US laws. The mandatory consumer protection provisions of your local law continue to apply.

16. General

  1. Survival. The following provisions survive the expiration or termination of this agreement for any reason whatsoever: Warranties, Disclaimers, Liability, Indemnity & Exclusive Remedies, User Content, Disputes, Feedback and Intellectual Property.

  2. Severability. Any clause of this agreement, which is invalid or unenforceable is ineffective to the extent of the invalidity or unenforceability without affecting the remaining clauses of this agreement.

  3. Entire Agreement. Our Terms of Service constitute the entire agreement between you and us and supersede all prior agreements. To the extent of any conflict or inconsistency between the provisions in these Terms of Service and any pages referenced in these Terms of Service, these Terms of Service will prevail.
